NEXTGEN VR — TERMS OF SERVICE
This page summarizes how bookings, payments, deposits, cancellations, equipment care, media, and liability work at NextGen VR. By using our website or participating in an experience, you agree to these Terms and our Privacy Policy.
1. Eligibility & Conduct
You must be of legal age to enter a binding contract (or have a parent/guardian’s consent if under 18). You agree to follow all posted and verbal safety instructions, use the Services for personal, non-commercial purposes only, refrain from damaging or tampering with our property, and comply with applicable laws. We may refuse entry or remove anyone behaving dangerously or disruptively.
2. Health & Safety Acknowledgment
VR involves physical activity and may not be suitable for everyone. By participating, you confirm you are in suitable health, not under the influence of drugs or alcohol, and will alert staff if you feel unwell or unsafe. You voluntarily assume risks including exertion, tripping, collisions, and motion discomfort.
3. Damage to Equipment & Facility (Negligence / Misuse)
a. Duty of care. Follow staff instructions and posted rules. Use equipment responsibly and only as directed.
b. Chargeable damage. You are responsible for damage caused by negligence, rough handling, or misuse, including but not limited to:
- Throwing or dropping VR headsets, props, or gear
- Striking walls or equipment during reckless play
- Twisting or yanking cables or trackers
- Improper use of props or sensors
c. Assessment & same-day charge. If equipment is damaged due to negligence or misuse, we may charge a reasonable amount on the same day to cover repair or replacement.
d. Dispute & refund. If you believe a charge was incorrect, submit a written dispute within five business days and we will review.
e. Our discretion. Minor wear-and-tear may not be charged.
4. Deposits, Cancellations & Rescheduling
a. Deposit. A deposit is required to confirm your booking. Cancellations made 48+ hours before your session are refundable.
b. Within 48 hours. Deposits are non-refundable. One reschedule may be offered at our discretion.
c. Late arrivals & no-shows. Arriving more than 10 minutes late without notice may forfeit the session.
d. Deposit usage. Deposits are applied to your session’s balance. In case of damage, they may be applied to repair costs.
e. Our cancellations. If we cancel for technical or safety reasons, you may request a refund or free reschedule.
5. Payments & Pricing
Prices are in Canadian dollars and subject to tax. Balance is due at check-in. We accept payment methods shown at booking. Prices may change.
6. User Content & Media
a. Complimentary highlights. Some sessions may include optional highlights. Guests must request before gameplay.
b. Media use. We may capture video or photos for safety or promotional use. Notify staff prior to your session if you do not wish to appear in promotional material.
7. Intellectual Property
All trademarks, software, designs, and media belong to NextGen VR or licensors. You may not copy or reproduce content without written consent.
8. Limitation of Liability
To the extent permitted by Ontario law, our liability is limited to the greater of $100 CAD or the amount you paid for your session.
9. Indemnity
You agree to indemnify NextGen VR for damages arising from your breach of these Terms or misuse of equipment.
10. Changes to Services
We may modify the Services at any time. If it materially impacts your booking, you may request a refund or reschedule.
11. Termination of Use
We may refuse service or terminate participation for violating these Terms or unsafe behaviour.
12. Governing Law & Dispute Resolution
These Terms are governed by Ontario law. Disputes are handled in Waterloo Region courts unless both parties agree to mediation or small claims.
13. Force Majeure
We are not responsible for delays caused by events beyond our control, including outages or emergencies.
